Meeting Call to order
Damon Wyche called to order the meeting of the Blakefield HOA Hearing Board Community at 10:40 am on November 3, 2018 at Cumberland County Public Library, 4809 Clinton Road, Fayetteville, NC 28312.
Roll call
Damon Wyche conducted the roll call by confirming all members signed the roster. All proxies present were accounted for. Meeting seconded by Jim Cogdell. The following HOA board members were present: Damon Wyche, Aaron Carter and John Kellum.
Agenda
Aaron Carter covered the meeting agenda:
I. Review of new proposed covenant changes/voting sessions
1. A new vote will be scheduled in the near future with a date to be determined. The voting location with the subdivision will be specified to get more community involvement. The next voting date will be posted on the website and on the HOA Facebook page on December 5th.
II. Closing of 2018 HOA Budget and 2019 Anticipated Expenses
1. Damon Wyche informed attending members that the budget as of November 3, 2018 stood at $24,071.31.
2. Review closing of 2018 HOA budget and expenses; Anticipated Budget for 2019 (Spreadsheet provided by Keri Alpers presented at meeting); Requirement for Legal Representation ($300/hour); Charges for landscaping to increase to add easements behind Pleasantburg Drive & Cinder Lane, Pleasantburg Drive and Cherry Hill Drive to be maintained by Snowslandscaping.
3. Determine an appropriate amount to be designated as surplus.
a. HOA Board has determined that $12,000 of the 2018 ending budget be set aside in reserve for legal representation. The HOA goal is to have enough funds in reserve to cover each household at a minimum of $1200 for legal representation. Attending members agreed that the HOA shall continue to impose dues (assessments) until a surplus of $75,000 to $100,000 in next 5 years is saved for future legal fees, major or long-term projects, neighborhood repairs or un-foreseen circumstances in effort to prevent the need for special assessments to be imposed. The goal for the surplus will be revisited in 5 years (2023).
4. HOA board proposed that $100 dues be assessed for the 2019 fiscal year. The proposal. Proposal was second by the attending members.
III. HOA Board’s Process to Remedy Late/Unpaid Dues (Assessments) & Covenant Violations Penalty Fees
1. Late/Unpaid HOA Dues; Covenant Violations
a. Aaron Carter reviewed with the members the HOA Board’s process to resolve the issues with late/unpaid dues and covenant violations fees by seeking legal action. The HOA board has sought out legal assistance of Tina Pace of Hatch, Little & Bunn. Pace will charge $300/per hour for court appearance, $100 per demand letter and $200 to file liens. The HOA board has been instructed to provide a 15-day demand notice to delinquent homeowners in effort to obtain unpaid HOA dues and/or penalty fees. Unresolved cases of unpaid HOA dues and/or penalty fees will be forwarded to the attorney after the 15 days.
IV. Neighborhood Improvement Projects
1. Security Entrance Gate
a. HOA Board was requested by attending members to continue to seek quotes and contractors for a security gate at the front entrance. Quotes and 3 selected contractors will be presented at the next HOA members meeting.
2. Speed Bumps
a. Jennifer Fisher addressed the members of her concerns with drivers speeding through the neighborhood, specifically vehicles traveling around the curve located near 4047 Pleasantburg Drive. Attending members requested the HOA board seek out quotes for speed bumps or speed humps within the neighborhood. A vote was taken with 26 of the attending members voting for speed bumps or humps to be placed in the neighborhood most susceptible or inviting for drivers to speed.
3. Community Benches
a. HOA board was requested by the attending members to obtain quotes for community benches to be placed within the neighborhood for those that need to rest when walking within the neighborhood.
V. Christmas Gathering
1. HOA proposed having a Christmas gathering on December 15th but the attending members would be required to plan the gathering and notify the HOA board via the website or facebook if they are interested in coordinating a gathering.
VI. Other Business
1. Attending members requested for HOA board to address the following issues noticed in the neighborhood: (1) homeowner’s allowing pets to urinate in other’s yards; (2) basketball goals positioned in away that kids playing basketball are in the roadways; (3) minors tampering with homeowner’s mailboxes; (4) drones flown in the neighborhood.
